Terms of Service

1. Introduction

Welcome to Nitrousdigital, a digital agency specializing in web development. By using our services, you are agreeing to comply with and be bound by the following terms and conditions, which together with our privacy policy govern our relationship with you in relation to this website and our services. If you disagree with any part of these terms and conditions, please do not use our services.

2. Services Provided

Nitrousdigital provides web development services, including but not limited to website design, development, and maintenance. Our services are intended for businesses and individuals looking to establish a professional online presence.

3. Intellectual Property Rights

All intellectual property rights in the website and materials produced by Nitrousdigital for the client, including but not limited to the design, text, graphics and source code, are owned by Nitrousdigital or its licensors. Subject to full payment of the agreed fee, Nitrousdigital grants the client a non-exclusive, non-transferable license to use the website for the client's own business purposes.

4. Payment and Refunds

The client shall pay the fees for the services as agreed upon with Nitrousdigital. If the client terminates the contract before the completion of the work, the client shall pay Nitrousdigital the proportion of the total fee that corresponds to the work completed. If the client terminates the contract after the completion of the work, no refund shall be given.

5. Warranty and Liability

Nitrousdigital warrants that the website will be provided using reasonable care and skill and that it will be free from defects in materials and workmanship for a period of 30 days after delivery. Nitrousdigital's liability to the client in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise arising in connection with the performance or contemplated performance of the contract shall be limited to the fee paid by the client for the services.

6. Confidentiality

Nitrousdigital shall keep confidential all information and materials provided by the client and shall not disclose any such information to any third party without the client's prior written consent.

7. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the country in which Nitrousdigital is located and the client agrees to submit to the exclusive jurisdiction of the courts of that country.

8. Changes to Terms of Service

Nitrousdigital reserves the right to make changes to these terms of service at any time. It is the client's responsibility to review these terms of service periodically for any changes. Continued use of our services after any changes have been made will constitute acceptance of those changes.

9. Dispute Resolution

In the event of any dispute arising out of or in connection with these terms of service or the services provided by Nitrousdigital, the parties shall attempt to resolve the dispute through friendly negotiation. If the dispute cannot be resolved through negotiation, the parties shall submit the dispute to mediation in accordance with the rules of the International Chamber of Commerce. If the dispute remains unresolved after mediation, it may be referred to and finally resolved by arbitration in accordance with the rules of the International Chamber of Commerce.
